Font de Stamp Terms of Use

Morisawa Inc. (the "Company") has established these Terms of Use ("TOU") governing the use of the Font de Stamp service (the "Service") by any person using the Service (the "User").

Article 1 (Application of TOU)

  1. TOU shall apply to all matters related to the use of the Service between the User and the Company.
  2. Any content generated by the User through use of the Service shall be referred to as "User Content".

Article 2 (License to User Content)

  1. Subject to the User's compliance with TOU, the Company grants the User a non-exclusive license to use the User Content including images and other materials, provided by the Company through the Service within the scope specified below
    1. To download the User Content and reproduce it in electronic form or on physical media (including photographs and stamps).
    2.   
    3. To make the reproduced User Content publicly available free of charge via the Internet. However, the User shall not use the User Content for commercial purposes.
  2. All intellectual property rights relating to the images and other materials provided by the Company through the Service shall remain within the Company. The license granted in the preceding paragraph is limited to the specified scope and does not constitute any transfer of such rights to the User

Article 3 (Disclosure via the Gallery)

The User may disclose the User Content to third parties by using the disclosure function of the Service. In such case, the User shall agree in advance that such third parties may use the User Content in the manner specified in each item of paragraph 1 of Article 2.

Article 4 (Prohibited Conduct)

  1. The Company prohibits the User from engaging in any of the following acts in connection with the Service.
    1. Using the User Content for commercial purposes.
    2. Uploading personal information (including names, addresses, telephone numbers, email addresses, etc.) of the User or any third party. However, this shall not apply if the User uses their own personal information under their sole responsibility, by limiting scope of use or disclosure.
    3. Infringing any copyright, trademark, trade secret, or other intellectual property rights of the Company or any third parties.
    4. Transmitting computer viruses, malware, or other harmful programs.
    5. Creating or making available any of the following expressions (including creating User Content incorporating such expressions)
      1. Expressions defaming, slandering or damaging the honor or credibility of any third party.
      2. Expressions infringing on the property rights (including passwords) or privacy of any third party.
      3. Obscene expressions.
      4. Excessively violent or discriminatory expressions.
      5. Any other expressions likely to cause discomfort to others.
    6. Conduct contrary to public order or morality.
    7. Any other conduct in violation of TOU.
  2. The Company may, at its sole discretion and without prior notice, delete any User Content that the Company determine to violate any of the above items.

Article 5 (Handling of Personal Information)

  1. When the Company obtains personal information in connection with the Service, the Company shall handle such personal information appropriately in accordance with the "Morisawa Personal Information Protection Policy.

  2. If personal information is included in the User Content, the Company shall use such information solely for the purpose of providing and maintaining the Service and shall not use it for any other purpose.

Article 6 (Management of My Page)

A URL will be issued for managing the User Content created by the User. The User shall strictly manage this URL to prevent its disclosure to any third parties. The Company shall not be liable for any damage incurred by the User as a result of such disclosure to any third parties.

Article 7 (Warranty and Limitation of Liability)

The Company makes no warranty, whether express or implied, regarding the Service and User Content, and provides them "as is" and "as available." However, nothing in TOU shall be construed to limit the Company's liability to the User beyond the scope permitted by law. This Article does not exempt the Company from liability for damages incurred by User as a result of the Company's intentional or grossly negligent breach of contract, tort, or other acts.

Article 8 (Suspension of Use)

If the Company determines that the User has violated TOU, or if the User falls under the provisions of Article 9, or if the Company otherwise deems it necessary for other reasons, the Company may take measures to prevent all or specific User from using all or part of the Service. The Company shall not be liable for any damage resulting from such suspension.

Article 9 (Suspension of Service)

The Company may, at its discretion and without prior notice, suspend all or part of the Service in any of the following cases. The Company shall not be liable for any damage resulting from such suspension.

  1. When required by applicable laws.
  2. When necessary for regular or emergency maintenance or repairs (e.g., to ensure the User security or to enable the User to use the Service in an appropriate manner).
  3. Any other cases where the Company reasonably determines that there are circumstances equivalent to those listed above.

Article 10 (Changes and Discontinuation of the Service)

The Company may, at its discretion, change or discontinue all or part of the Service at any time.

Article 11 (Revisions to TOU)

  1. The Company may, at its discretion, revise TOU ("Revised Terms"), or establish additional terms supplementing TOU ("Additional Terms") at any time .
  2. The Company shall post the Revised Terms and Additional Terms on its website at least seven (7) days prior to their effective date. However, if the Revised Terms or Additional Terms are disadvantageous to the User, the posting shall be made at least thirty (30) days prior to their effective date (these periods, collectively "Acceptance Period"). The Company shall notify or announce the revised or additional terms, their effective date, and the reasons for the revisions or additions to the User via email, posting on the website, or other appropriate means. If the User does not accept the changes to TOU, the User may refuse the changes by ceasing to use the Service after the Acceptance Period. If the User does not refuse during the Acceptance Period or if the User continues to use the Service after the changes to TOU, the User shall be deemed to have agreed to the changes to TOU.

Article 12 (User Responsibility)

  1. If the User caused damages to the Company in connection with the use of the Service, the User shall compensate the Company for all such damages.
  2. If the User receives any claims or becomes involved in disputes with any third party in connection with the use of the Service, the User shall resolve such claims or disputes at its own expense and responsibility.

Article 13 (Governing Law and Jurisdiction)

TOU shall be governed by laws of Japan, and any disputes in connection with TOU shall be subject to the exclusive jurisdiction of the Osaka District Court or the Osaka Summary Court as the court of first instance.

Yes. As stated in the terms of use, digital stamps published in the gallery may be downloaded and used by third parties.
